2. What "Sale" Means Under California Law

The California Consumer Privacy Act, as amended by the California Privacy Rights Act, defines a "sale" broadly. It covers selling, renting, releasing, disclosing, transferring, or otherwise communicating a consumer’s personal information to another business or third party for monetary or other valuable consideration. The phrase "other valuable consideration" is what surprises most businesses: an exchange does not have to involve money to qualify.

A business can be sharing personal information even when no money changes hands.

3. What We Do Instead

We disclose personal information to service providers who process it on our behalf, under contract, and only for the purposes we specify. Under California law this is a service provider relationship rather than a sale. We will ask the agent to provide written proof of your authorization, and we may contact you directly to confirm that you granted it. If the agent holds a valid power of attorney under California Probate Code, additional confirmation from you is not required.

8. No Discrimination

We will not deny you services, charge you a different price, provide a different level of quality, or retaliate in any way because you exercised a privacy right. Declining analytics cookies does not degrade your experience on this website, and submitting a privacy request has no bearing on any proposal, quote, or service agreement.

9. Minors

We do not knowingly collect personal information from anyone under sixteen, and we do not sell or share the personal information of minors under any circumstances.
